Chapter 102. Erosion and Sediment Control

Soil erosion is a natural process by which topsoil is worn away under water, wind, or chemical action.  Accelerated erosion is the removal of soil at a greater rate than would naturally occur on its own, often by human activity. Earth disturbance from construction activities often promotes accelerated erosion which can lead to sediment pollution in our waterways and the loss of property. Sediment is the #1 pollutant in North Central Pennsylvania's waterways. 

The BCCD is dedicated to serving individuals living and/or working within Bradford County by minimizing soil erosion for earth disturbance sites and the sediment pollution these events make when they reach our waters of the Commonwealth. We are able to do this through our delegation agreement with the PA Department of Environmental Protection, which authorizes our staff under Title 25 Chapter 102 Erosion and Sediment Control regulations to offer a number of services through the program. Through this agreement we are able to:
  • offer personal in-office and in-field technical/educational guidance,
  • provide complaint assistance,
  • assure the proper implementation of necessary Erosion Control Best Management Practices,
  • review/process NPDES (National Pollutant Discharge Elimination System) Construction, ESCGP-2 (oil-gas related) and E&S (timber harvesting and road maintenance related) permit applications as well as standard (non-permit) erosion control plans. 
Since 2006, our Conservation District has reviewed over 286 National Pollutant Discharge Elimination System (NPDES) general permits, 15 Erosion and Sediment Control General Permits (ESCGP) for oil and gas, and over 854 small project E&S plans to help make sure they are using the Best Management Practices (BMPs) for their sites to stop sediment pollution. Over these years, we have reviewed and inspected the earth disturbance of 9,706 acres of land in our county and helped keep that sediment on the work site and out of our streams, helping the Chesapeake Bay.

 What type of E&S Plan does my project need?
This is one of the most common questions we receive at the BCCD, and the answer depends on the type of work that is being completed for the project. The diagram below shows what type of E&S Plan you will need for your project. ​

Once you know if you will need permit for the project you are proposing, it is important to consult with a professional service provider and submit the needed forms and applications before starting any earth disturbance. ​

Small Projects (Non-NPDES) E&S Plan

Chapter 102 requires all projects over 5,000 sq. ft but under 1 acre to have a written E&S Plan. 
This plan does not have to be reviewed and approved by the BCCD unless:
  • it is required under local ordinances and zoning
  • it is needed as part of a DEP Permit (i.e. Chapter 105, wetland permits)
  • it is located within a High Quality (HQ) or Exceptional Value (EV) watershed or has the potential to discharge to these waters.

Fee Schedule

The BCCD required a flat fee of $500 for projects that propose 0.99 acre or less of earth disturbance. If the submitted plan involves a major or minor amendment for a previously approved project, then the District fee is $200 for the new review. Payment is required by cash or check to the “Bradford County Conservation District”.

National Pollutant Discharge Elimination System (NPDES) 

Projects disturbing 1 acre or more require the submission and approval of a General NPDES Permit or Individual NPDES Permit application. This includes any type of earth disturbance that is done in phases or is part of a larger common plan of development that will be over 1 acre of earth disturbance.  This submission must be completed with assistance from a professional service provider and satisfy all items detailed on the NPDES application checklist. 

PAG-01 General NPDES Permit for Stormwater Discharge Associated with Small Construction Activities are available for projects that are less than 5 acres and meet all the PAG-01 specifications. PAG-02 General NPDES Permit for Stormwater Discharge Associated with Construction Activities is the most common General Permit used for construction activities.  In order to be approved for this permit your project must meet the nine (9) requirements.  

For sites that are not able to meet the requirements of a General NPDES Permit or are in a special protection watershed, an Individual NPDES Permit for Stormwater Discharge Associated with Construction Activities must be completed.

For projects proposing 1 acre or more of earth disturbance, see the attached fee schedule to calculate the District fee. Three separate checks containing their respective amounts must be submitted to "Bradford County Conservation District,' "Bradford County Clean Water Fund," and "Commonwealth of Pennsylvania Clean Water Fund."

Timber Harvesting E&S Plan

Chapter 102 requires E&S Plans for all earth disturbing activities over 5,000 sq. ft. and that includes timber harvesting activities.  For timber harvesting over 25 acres an Erosion and Sediment Permit is required under Pennsylvania's Clean Streams Law, instead of a General NPDES Permit.
